Chalet Chintalaya
Booking Terms & Conditions
Please read carefully the booking terms and conditions set out below before booking your holiday with Martin Cadman trading as Chalet Chintalaya (hereinafter called Chintalaya). These booking conditions form the basis of your contract with Chintalaya and set out the respective rights and obligations of both parties.
The Booking Form and Deposit
To make a booking, the enclosed booking form must be completed and signed by the person organising the holiday (group leader). The group leader must be over 18 years of age at the time of signing and he/she must be authorised to make the booking on behalf of all persons listed on the booking form. Once the group leader has signed the booking form he/she is confirming that they are authorised to do so by all members of the group and that all group members agree to be bound by the booking terms and conditions set out by Chintalaya.
Any person signing the booking form guarantees payment of the full cost of the holiday.
A deposit of 25% of the total cost is payable at the time of booking and should be included with the completed booking form. Deposits are non refundable except where we are unable to accept your booking.
Payment
The balance of the holiday must be paid to Chalet Chintalaya no later than 8 weeks before the commencement date of the holiday. For bookings made within 8 weeks of the commencement date the full cost of the holiday is payable at the time of booking. In all cases Chintalaya reserves the right to cancel the holiday arrangements without any obligation to the customer if he/she fails to make the payments as stipulated.
Prices
Chintalaya reserves the right to change the website prices at anytime before your booking is accepted. Once your booking has been accepted we guarantee that the price will not change and no surcharges will be added unless you amend your booking in anyway.
Cancellation or Alterations by the Client
If for any reason you or a member of your group has to cancel their holiday a cancellation charge will apply as set out below. Cancellations will take effect only when written notification from the person signing the booking form is received by Chintalaya. Cancellation fees will be charged as follows:
Notification received before holiday commencement date.
More than 56 days - Deposit
56-29 days - 50%
28 -15 days - 70%
Less than 15 days - 100%
You may change your booking up to 15 days before the commencement of your holiday if any member of your party is unavoidably prevented from travelling and a suitable transferee is found who meets all the conditions applying to the holiday. The right of transfer is subject also to the appropriate conditions in the respect of insurance being met and the payment of a £50.00 administration fee.
Alterations or Cancellations by Chintalaya
In the unlikely event that because of situations beyond the control of Chintalaya we have to make any major alterations to or cancel your holiday you will be entitled to a full refund. Chintalaya reserves the right at any time to substitute for the accommodation described in its website, alternative accommodation of a comparable standard of comfort. If the client chooses not to accept the provision of alternative accommodation and cancels the holiday, the client will be entitled, and Himalaya's liability will be limited, to a full refund of the cost of the holiday paid by the client to Chintalaya.
Chintalaya Liability
Subject to the immediately preceding term Chintalaya accepts responsibility for ensuring that the holidays that you book with us are supplied to you as described in the website and the services offered reach a reasonable standard. If any part is not provided as promised, we will pay you appropriate compensation, if this has affected the enjoyment of your holiday.
Chintalaya accepts responsibility for personal injury and death as a result of negligent acts and/or omissions of our employees or agents and suppliers contracted or sub contracted by Chintalaya to provide services in connection with your holiday arrangements with Chintalaya.
Chintalaya does not accept responsibility where there has been no fault on the part of the company or its suppliers.
Chintalaya will not arrange your travel by sea, rail or air and accordingly Chintalaya cannot accept responsibility for injury or loss suffered as the result of the acts or omissions of the providers of such services. Such arrangements are entirely your responsibility and you should ensure that they are made through a reputable provider.
Damage by and behaviour of the Clients
All damages and breakages caused by any client will be charged back to the client and must be paid in full before vacating the chalet. The client must undertake to behave in an orderly manner and not disrupt the enjoyment of others on holiday or in anyway harm the reputation of Chintalaya with local residents or suppliers. The holiday of any client or party in breach of this clause will be terminated immediately and without compensation and Chintalaya will have no further contractual obligations towards them.
Website Accuracy
Chintalaya has made every effort to ensure that the information contained within the website is correct at time of going to press but such information may be subject to alteration. It should be noted that the resort facts are for guidance only and the pictures printed in this website are used to give a general impression of the accommodation offered. The website was produced in May 2006.
Complaints by the Client
Should a problem occur during your holiday please inform a member of the Chintalaya resort team as soon as possible. We will then do everything we can to resolve the problem. If the complaint cannot be resolved in the resort, please write to us at Chalet Chintalaya, 22 Fentham Road, Hampton-in-Arden, West Midlands, B92 0BD within 28 days of your return from your holiday, giving all the relevant information. We regret that we cannot accept liability in respect of any complaints, which are not notified entirely in accordance with this clause.
Passports, Visa and Health
At the time of going to print, people holding full British or EC Passports do not require a visa to visit France. For people travelling from other countries outside the EC, please consult your embassies for any visa requirements. Please note that children must hold their own passports. It can take up to 4 weeks to issue or renew a passport, so please allow yourself enough time if it is necessary to do so. No vaccinations are required for visiting France at the time of going to print.
Jurisdiction
The contract is made on the terms of these booking conditions and form the agreement between Chintalaya and all persons listed on the booking form. The contract is governed by and in accordance with English law and both parties agree to submit to the jurisdiction of the English courts at all times.
